GENERAL INFORMATION
The purpose of these general terms and conditions of sale is to govern the contractual relations between LA SASU BLP, operator of the online store equestrian-shop.fr, and the consumer defined below as the user of the equestrian-shop.fr website and accepting these general terms and conditions of sale. These general terms and conditions of sale specify in particular: The conditions of order The modes of regulation The conditions of delivery and management of possible returns of products ordered by customers. The customer can consult these general conditions of sale simply, freely and at any time by clicking on the link "General Conditions of Sale". Thus, any order for a product placed by a customer will imply the customer's definitive and irrevocable agreement to all of the general conditions of sale presented below. These general conditions of sale are subject to change, in which case the applicable conditions are those in force on the site on the date of the order.
VALIDATION OF ORDERS AND ELECTRONIC SIGNATURE
(law of March 13, 2000 on electronic signature.) Any purchase order signed by the consumer by “click” constitutes an irrevocable acceptance that can only be challenged in the cases strictly provided for in these general terms and conditions of sale such as “right of withdrawal” and “out of stock”. The click constitutes an electronic signature. This electronic signature has the same value between the parties as a handwritten signature. The contractual information will be confirmed by e-mail. Some orders may be subject to control by our verification department. In this case, you will be notified by e-mail of the supporting documents to be sent.
ORDER CONFIRMATION
In order to obtain final validation of your order, BLP reserves the right to cancel the order in the event of non-receipt of payment, supporting documents or receipt of documents deemed non-compliant. Any order paid by check will only be processed upon receipt of the means of payment, shipping times will be recalculated from the date of receipt of the means of payment. BLP recommends that the customer keep the data relating to their order on paper or on a reliable computer medium. The customer must check the completeness and conformity of the information (write their first and last name or company name in full) that they provide to BLP in order to avoid any delay or error in delivery, and any additional costs incurred by them.
PROOF OF TRANSACTION
The computerized records, stored in the computer systems of the company EBLP under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties. The archiving of purchase orders and invoices is carried out on a reliable and durable medium that can be produced as proof.
OUT OF STOCK
BLP shall not be held liable for non-performance of the contract concluded in the event of a stock shortage or unavailability of the product, force majeure (disruption or total or partial strike, in particular of postal services and means of transport and/or communications, natural disaster, permanent discontinuation of the item ordered). BLP shall not incur any liability for any indirect damages resulting from these terms, loss of business, loss of profit, damages or costs, which may arise from the purchase of the products.
PRODUCT INFORMATION
The BLP company presents on its website products for sale with the necessary characteristics that allow compliance with article L 111-1 of the Consumer Code, which provides the possibility for the potential consumer to know before the final order the essential characteristics of the products he wishes to purchase. Many products are handcrafted, their shape and color may vary significantly from the photos and their dimensions are approximate. The photos are not contractual. Regarding semi-precious stones, it should be noted that some of the products offered are synthetic in nature, but in any case this particularity is specified in the product sheet. Although our magnets have a weak magnetic field, the persons concerned are advised to check their sensitivity to our magnets. The offers presented by the BLP company are only valid while stocks last. The products offered comply with current French legislation and the standards applicable in France. Hypertext links may refer to sites other than the equestrian-shop.fr site. BLP disclaims all liability in the event that the content of these sites contravenes the legal and regulatory provisions in force.
PRODUCT AVAILABILITY
The order will be executed at best within 24 hours and at the latest within 5 working days from the day following that on which the consumer's order was definitively validated (means of payment received and order verification procedure carried out).
In any event and in accordance with the provisions of Article L121.20.3 of the Consumer Code, the products ordered may not be delivered within a period exceeding one month from the full payment of the order. In the event out of stock , in particular due to suppliers, the consumer will be informed as soon as possible and will have the option of either canceling their order or replacing the missing product with another product of equivalent characteristics and price. The consumer will then have the choice of requesting either a refund of the sums paid within 8 days at the latest following their payment, or an exchange of a product of equivalent characteristics and price, if BLP is able to obtain it. In the event that an exchange is not possible, BLP reserves the right to cancel the customer's order and refund the sums paid. Since information on the unavailability of products is the responsibility of our suppliers, this cannot engage the responsibility of BLP or give rise to any right to damages for the customer.
RIGHT OF WITHDRAWAL
The legal withdrawal period is 14 calendar days. During this period, the consumer may return, at his own expense, products that do not suit him. This period runs from the day of delivery of the consumer's order. Any return must be reported in advance to BLP's Customer Service by email with the contact us link. The consumer must return his products by tracked Colissimo 48H, with proof of deposit with or without signature, or additional insurance guaranteeing him, where applicable, compensation for the products up to their real market value in the event of theft or loss of these goods. This right of withdrawal is exercised without penalty, with the exception of return costs which remain the responsibility of the consumer. In the event of the implementation of the right of withdrawal, the consumer has the choice of requesting either a refund of the sums paid, or an exchange of an amount equivalent to the sums paid or higher with additional payment. In the event of implementation of the right of withdrawal, BLP will do its utmost to reimburse the consumer within 15 days from the date of receipt of the package with all the goods. The consumer will then be credited back to his bank account (secure transaction) in the event of payment by credit card; he will be reimbursed by check in other cases.
METHOD OF PAYMENT
To pay for his order, the consumer has the choice of all the payment methods referred to in the order form, namely: credit card, check, PayPal, transfer. In the event of payment by check, it must be issued by a bank domiciled in mainland France or Monaco. Any order paid by check will only be processed upon receipt of the means of payment. Availability and shipping times are to be recalculated from the date of receipt of the means of payment. Checks are cashed upon validation of the order. The consumer guarantees to BLP that he has the authorizations that may be necessary to use the payment method chosen by him, when validating the order form. BLP reserves the right to suspend any order management and any delivery in the event of refusal of authorization for payment by credit card by officially accredited organizations or in the event of non-payment. BLP reserves the right to refuse to make a delivery or to honor an order from a consumer with whom a payment dispute is currently being administered. BLP reserves the right to ask the customer to provide it with a copy of an identity document and/or proof of address. The order will then only be validated after receipt and verification by our services of the documents sent. If these documents are not received within 15 days following the placing of the order, the latter will be deemed to be automatically canceled. EBLP retains full ownership of the products sold until full payment of all sums owed by the consumer in connection with his order, including costs and taxes. The transfer of ownership of a good purchased from BLP by the consumer to a third party will not be supported by BLP. Only the original purchaser of this good may claim access to the clauses of these general terms and conditions of sale.
PRICE INFORMATION
Prices are indicated in Euros and are only applicable on the date the consumer sends the order confirmation. They do not take into account delivery costs which are charged in addition, and indicated before the final validation of the order. Full payment must be made when ordering. At no time can the amounts paid be considered as deposits or down payments.
DELIVERY TERMS
The products are delivered to the address indicated by the consumer on the order form. The customer must check the completeness and conformity of the information he provides to who cannot be held responsible for any data entry errors and the consequences in terms of delay or delivery error. In this context, all costs incurred for the reshipment of the order will be entirely borne by the customer. The “Colissimo suivi” system allows delivery within 48 hours (average time observed: 2 days) The consumer will be notified by email of the date of dispatch of his order. In the event of a delivery delay of more than three days compared to the date indicated in the dispatch email, we suggest checking with your post office that the package is not pending, then if necessary to notify us of this delay by sending us an email to customer service contact.equestrian@gmail.com by indicating the TRACKING NUMBER (from the post office) BLP will then contact the Post Office to start an investigation. A Post Office investigation can last up to 21 working days from the date it was opened. If the product is found during this period, it will be re-sent to you immediately. If, on the other hand, the product is not found after the 21 working day investigation period, the Post Office will consider the package lost. It is only after this period that BLP will send you a replacement product, at its own expense. If the product(s) ordered were no longer available at that time, the amount of the products affected by the carrier's loss would be refunded to you by BLP.
DELIVERY
The order preparation time is 24 to 72 hours (except during equestrian events indicated on the home page, additional time of 5 days) and an additional time of 48 hours for shipping, by La Poste.
All packages with a value greater than 90 euros will be sent by Colissimo against signature .
Products delivered to Switzerland or other countries outside Europe may be subject to a customs clearance tax. consumer charge .
The buyer is required to check, in the presence of the postal worker, the condition of the packaging and the goods at the time of delivery. Any anomaly concerning the delivery (damage, product missing from the delivery note, damaged package, broken products, etc.) must be indicated on the delivery note in the form of “handwritten reservations”, accompanied by the customer's signature. It is essential that the customer has the postman or the post office on which he depends draw up a “report of spoliation” (report 170) so that La Poste can open an investigation leading to a compensation procedure.
The consumer must simultaneously send a copy of this letter, with the original of the "report of spoliation" if applicable, by simple mail to: BLP - 20 RUE D'EN BAS - 78980 ST ILLIERS LE BOIS - FRANCE. Any claim received after the deadline will be rejected. In the event of delivery of a defective product or one that does not comply with the order, the consumer must make a claim to BLP, by email to contact.equestrian@gmail.com , no later than two working days following the signing of the delivery slip. Any claim made after this deadline will be rejected without the possibility of appeal. Any claim not made in accordance with the rules defined above and within the time limits will not be taken into account and will release BLP from any liability towards the consumer. Upon receipt of the claim, BLP will assign a return number for the product(s) concerned and communicate it to the consumer. The return of a product can only take place after the allocation of this agreement number according to the procedure presented above. Any product to be exchanged or refunded must be returned in its entirety to the company BLP within 8 working days following receipt of the return agreement, to the following address: BLP – 20 RUE D'EN BAS – 78980 ST ILLIERS LE BOIS – FRANCE. To be accepted, any return must be reported in advance to the Customer Service of the company BLP. Failure to comply with the above procedure will result in no claim for non-conformity or apparent defect in the products delivered being accepted.
APPLICABLE LAW AND JURISDICTION
These general conditions are subject to French law for both substantive and formal rules. In the event of a dispute or complaint, the consumer will first contact EBLP to obtain an amicable solution. Any dispute that cannot be settled amicably will be submitted to the jurisdiction of the Commercial Court of Versailles 78 in the jurisdiction of which the company is located. This contract is governed by French law.
